Terms and Conditions (AGB)
GENERAL TERMS AND CONDITIONS (AGB)
- Scope
These General Terms and Conditions apply to all orders placed through our online shop at [yourdomain.com] by consumers and businesses. A consumer is any natural person who concludes a transaction for purposes that are predominantly outside their trade, business or profession.
- Contracting Party
The purchase contract is concluded with [Company Legal Name],[address], Germany.
- Conclusion of Contract
The presentation of products in the online shop does not constitute a binding offer. By clicking the “Order with obligation to pay” button, you place a binding order for the goods in your cart. We confirm receipt of your order immediately by email; this confirmation does not constitute acceptance of the order. The contract is concluded when we accept your order by a separate confirmation email or by dispatching the goods.
- Prices and Shipping Costs
All prices are total prices and include the statutory German value added tax (VAT). Shipping costs are shown separately during the order process and are displayed before you submit your order.
- Payment
Payment is made via the methods offered during checkout (e.g. credit card, PayPal). Payment is due immediately upon conclusion of the contract.
- Delivery
Delivery is made to the address provided by the customer.
Delivery times are stated on the respective product page.
- Retention of Title
The goods remain our property until full payment has been received.
- Statutory Warranty (Gewährleistung)
The statutory warranty rights apply. For consumers, the limitation period for claims for defects is two years from delivery of the goods.
- Right of Withdrawal
Consumers have a statutory right of withdrawal as described in our separate Right of Withdrawal notice.
- Dispute Resolution
The European Commission provides an online dispute resolution platform: https://ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
- Applicable Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of their country of habitual residence.
